      My moan is....Mr Kandy and his sister spent many hours filling in probate forms to get his late dad's affairs sorted.I took the large envelope down to our post office three weeks ago and had it sent to the Probate office by recorded delivery so that it would get there safely and the process could begin.

      Three weeks later we hadn't heard anything back so Mr Kandy phoned them up on Friday to see if they had received all the relevant forms etc only to be told that a letter had been sent back to him to let him know that he had forgotten to add the death certificate:scratch::sad:.As Mr Kandy was talking to the Jobsworth letting him know that everything had been sent correctly the Jobsworth suddenly told Mr Kandy to ignore the letter as they had just found the certificate and that they would be sending out details of where he and his sister need to go to swear the oath that everything they have written on the forms is correct so that probate can be granted and they then can start to sort out the sale of the house etc. They already have people interested in the property and they know they can't go through to completion until probate has been granted,but his sister has to keep trekking over to the house,to make sure the heating is still ticking over ok and that the place hasn't burnt down,but you would think that these so called officials could get something right,after all they have had enough practise what with the amount of people who pass away each year...:nonofinger:

        Same as dealing with the tax people. Their rules seem to go in circular references that turn into multiple question marks. Is it allowable, is it not allowable......:scratch: :wallbanging:

          @silu I'm sorry I've only just caught up with your post. What an exceptionally rude man. Well done for asking the workmen to slow down I'd have done the same under the circumstances! As for the dog poop I might have returned that to him on the end of my trowel! :whistle:
          I hope the dog didn't cause too much damage. :fingers crossed:

            I haven't seen the dreadful man or the person who wanted to relieve me of some of my Aconites either so back to being blissfully quiet in the garden I'm pleased to say so NOT a moan from me for a change:).

              @CanadianLori,Mr Kandy received the information they were waiting for but have found that his sisters address(road name) has been misspelt by some Jobsworth who needs their eyes testing so Mr Kandy had to ring up informing them of the fact and was told that when they go to swear the Oath then the correction has to be done in front of the solicitor who will witness the change.You couldn't make this up and they are having to pay £215 for the pleasure of this:sad:

                The government are proposing to put up the Probate fees considerably. Any estate valued at over £50,000 (that's less than almost any house in the country) would have a fee of about £300 and then on a sliding scale up to £20,000 :yikes:

                An average three bedroom house in London would attract a fee of around £3,000.

                      Shiney,I read that out the other week to Mr Kandy,I think it was in the Daily Wail but not too sure.These sponging governments will find any way to bleed more money out of all of us in one way or another:sad:

                      Sorry @Beckie76 I have written it in a misleading way.Just to apply for probate is £215.Mr Kandy and his sister have had to print off all the forms from the proper goverment website for wills and probate and how to apply and so I expect all this money goes into this countries coffers to pay the Jobsworths wages.After they have sworn the Oath they then have to sign the forms and then get charged £5 per signature by the Solicitors.In front of the solicitor they have to change the address to the correct one and then have to initial the change (in front of the solicitor):snorky: They have been sent a list of all the stuff they have to take with them.Good job they haven't got to trek all the way to Leicster to do it all:snorky:

                      I only hope that I pop my clogs before Mr Kandy as I have no one that could do all this sort of thing for me as we have no kids and all my family are busy with their kids lives to worry about me.I think if I am the last one I shall do what my friend did and hand it all over to the solicitor to sort out:snork:

                      I am only writing it down on here so people can get an idea as to what it all entails when someone passes away as it has been a real eye opener I can tell you:sad:

                        Hi Kandy, didn't you think of just going to a solicitor who deals in probate etc. When my dad died two years ago my mom and I went to one and she did absolutely everything. All my mom had to do was provide a list of assets at the start and then sign for everything once it was settled, around 6 weeks later. There were no extra fees involved for signatures, letters, phone calls, postage etc etc. She even transferred the flat deeds into my moms name and dealt with my moms bank in transferring the money over. Also, she gave my mom the cheque to cover the funeral etc. All this only cost £300, a one off flat fee.

                        I think personally that it's always worth ringing round a few solicitors to get quotes before you start, as you have to remember they are running a business independent of Government etc, so you're always going to get some that are cheaper than others.

                        PS, forgot to say you don't have to pay them a penny, it comes out of the estate once everything is sorted.

                          I'm with you now @Kandy. Gosh what an utter pain in the neck, I hope once all this paperwork is sorted that will be the end of & things will get sorted quickly for you. In the meantime be kind to yourselves & try not to get too stressed.....easier said than done.

                          Thanks for bringing this to everyone's attention, I've found it a real eye opener :dbgrtmb:, it's one of those subjects that people don't really talk about & as I've never personally come into direct contact with such an ordeal I have to admit I didn't really know anything about it. When we lost Nan she had already put the house into her sons names & there was very little money so two phone calls & one trip to the solicitor who held her will & all was sorted, it was as easy as that!

                            @Anthony Rogers i agree with you but my husbands family don't like parting with their money so would prefere to do it themselves and as i am only an in law I don't get much of a say in it.When my mum passed away my eldest brother and the solicitors were the executors so none of us others had to do anything apart from clear her house that is.

                            Isn't the estate the value of everything my father in law owned so even though they are paying up front for everything it will just mean less going to them when the estate has been wound up:scratch:

                            The other problem they have is that one of their cousins(on their late mums side)who lives along the row of houses my father in law lived in would like to buy the house after viewing it but Mr Kandys sister wants it sold to the person who viewed the house first when my father in law was still alive and this person is still interested in it even though they have never made an offer on it.We don't want any arguements or falling out but we would rather it stay in the family so to speak but I think she is going to dig her heels in to get her own way.:sad:

                            @Beckie76 I think the goverment was looking at one point in closing the loophole where you could sign your house over to your kids.We have never been in that situation so don't really know how it all works,but yes People need to talk about these things as often it is the only way we can all help each other with advice we can all share:smile:

                              Miss Jiff and me went to do some voluntary work this morning (first time) well we spoke to the people and it seemed to be nice, we said we had some plants looking for a home (15 plants), well we went but we will not be going back:mute: and we hope that the plants we took will be ok but we're not sure:sad::sad::sad::sad:

                              Voluntary work is meant to be rewarding both ways. I've held two voluntary positions; one was enormously rewarding and the other was spoiled by the person with responsibility.
                              Don't give up on the idea though ... just ... maybe ... somewhere else?
