    Let's be honest, the whole criminal justice system needs overhauled:

    Are both crimes? Absolutely, yes. Is there any consistency in the sentencing? None.

    If we are short of prison spaces, here is a radical idea.. build more! Even more radical, if the offender is an immigrant, send them back to their home country at the START of their sentence and let their home country deal with them.

      If you steal a Rolex watch, that is no different to looting. In fact, it is probably worse in that you select an individual victim, terrify them, and take something of enormous monetary value.

      The fact that so many people are being jailed for rioting is a failure of society - education, integration, provision of services, opportunities for progressing in life. All these things in a state of collapse is bound to lead to unrest.

        If someone steals, then THEY should be the one to reimburse the victim, NOT insurance companies. If they can't pay, then they work for the good of society, until their "pay" is sufficient to reimburse the victim.
        Repair potholes, properly, for a start.

        For rapists, remove a certain part of the anatomy. For rioters - clean the streets.
        I'm sure suitable punishment could be thought up for other criminals.
        The death penalty, while it might seem apt, I would be loathe to implement, just in case of errors.

        There are some in our prisons that are 100% known premeditated murderers.
        Terrorists would be top of the list along with serial killers.

        They are the ones that should hang, it's quick if done professionally.

              The death penalty is tricky. If you assume individuals have total free will and violent behaviour is an active choice, then it might seem justified. If you believe brain development plays a significant role, then things become less clear cut. No one chooses their genes. Children have no say about their environment, in the womb and beyond.

              A US research project I read about some yrs ago scanned the brains of violent prisoners and found almost all of them had damage to, or developmental irregularities within, the frontal cortex, which controls impulses. Can you penalise someone for having an attribute they can't change?

              We penalise people for attributes they can’t change all the time. Black people. Women. Disabled people.

              We apply the death penalty to animals in their zillions. Completely innocent creatures. Anyone balking at the idea of doing it to a human being has a very warped sense of humour in my opinion.

              Plus, war is everywhere. And what happens in wars? Ah yes, we kiss and make up.

                My grandfather, who was a drayman, used to deliver to Albert Pierrepoint’s pub. Apparently Mr P was a really nice chap ….

                  There will always be ways of coming up with reasons why people do things.
                  So is it time we just let every criminal off because some thing happened to them in earlier years or they have faulty gene.

                  All those rioters probably have faulty genes or frontal lobe problems, and now they are being penalised.

                  Locking someone up for the rest of their life because they have a faulty gene doesn't sound right to me either.

                        Be careful what you wish for. There are numerous cases where someone has received the death penalty, the sentence carried out and the person later found to be innocent of the crime. Do you then find the Judge, Jury and Lawyers involved in those cases guilty of murder and condemn then to death ? Of course not. You may be lucky enough to get a long drawn ourt Public Inquiry and maybe even an apology but the deed has been done.
                        If the death penalty were to be reintroduced here, it would seem strange that we remain squeamish about making Assisted Dying legal - for any reason - terminal illness or simply a strong desire to say Goodbye.
                        Before anyone picks me up on this, I'm not suggesting it's good for people - particularly young people - to be encouraged by maniacs on SM to harm/kill themselves. There are people out there who are mentally competant, not victims of "influence " but wish to end their lives and would welcome legalised assistance.
