    What's that notice attached to the gate - looks like it could be a planning application, are West Dorset planning notices on white A4 sheets?

      Is that a footpath entrance or a vehicular entrance with a wide gate behind overgrown 'anti-traveller' mounds? Sometimes you can get a better image from Streetview if viewing coming from the other direction.

      You mention above about checking on application for PP in the vendors name. Does that mean you haven't done a map check of the sites's planning history? If the council's website doesn't have that facility, you will need to visit their offices to view it.

          Heard back from the vendors, they are claiming they have had vehicular access since the 1960's and possibly longer.

          Wonder what sort of vehicle they were driving up the track in the picture? A unicycle?

            I'm gonna print off the Google streetview pic and ask them how they managed to drive thru a blackthorn bush.

            Think they're trying to pull a fast one :paladin:

              They will have to show in writing that they have such rights but I'm pretty sure that they don't have to regularly, or occasionally, use that access. But that is not the principle in Ziggy's case. When the land was being sold all such rights "owned" by the Vendor should have been declared during the sale and before the contract was signed.:dunno::coffee:

                Been studying google earth and streetview. It really looks like there was no track or road access until recently, yet they are claiming 40 years+ and are willing to swear a statutory declaration to this.

                Simple way of finding out, i'm going to ask the neighbours tomorrow.

                  The track doesn't have to be there, Ziggy, but the rights for access do. A Statutory Declaration is not worth the paper it's written on they have to produce written evidence and proof of the rights they are claiming. If they can produce written evidence, okay, but if they didn't declare those rights in the sale then you have a case for claiming compensation from them.:coffee::snork:

                    Still waiting to hear back from the council. I asked them if a planning application had been submitted for access onto a highway. Looks like they didn't or they wouldn't have tried this 40 year thing.

                      I tried to jump through a blackthorn bush once. I genuinely believed that if I calmed the mind and focused on an image of me leaping through successfully, then it would work. Good job my dad was with me and he had the loppers with him. No part of me was in contact with the floor. I was literally suspended in the thicket.

                        I can see where you were coming from in a quantum sort of way.

                        If all your molecules had lined up at the same time and in the same direction as the bush's molecules then it should have been theoretically possible for you to pass straight thru without interaction.

                        Just don't work that way after a few beers though :sad:
