Is this a banned plant?

    yes it can, but it doesn't look like Cleome to me

    I've got some Cleome seeds on their way in the greenhouse so I know it isn't that.

    Update: What I have done is taken it out of the ground and potted it on just to see what it grows into. When I took it out of the ground I noticed the stem was very rough just like a Cleaver. While I was digging the plant out I found another four of them. I've only potted one on though.

      If you'd potted up several hundred of them it might have made it difficult to plead innocence.

          Yeah, I reckon it is a juvenile leaf of that naughty plant. It's common in bird seed and is a largish black/grey pip. I personally wouldn't have, er, potted up, cos that looks like you are deliberately cultivating it. There's a lot of variation in leaf shape cos naughty people breed many different varieties from two species. C. sativa and C. indica. I remember seeing C. indica growing wild/naturalised in Southern China. Much to the amusement of backpackers it grew to 2.5m tall in ditches. Even I posed for a photo next to one.

          I think the young stem and leaves will smell when you rub them if it's naughty.

              Another 'yes' here....my parents ended up with an impressive 6' monster under their bird table one year. Shame they didn't know what to do with it:biggrin:

                        (wiseowl's reference was the one I was thinking of. It'd make a great architectural plant at the back of a herbaceous border, like castor oil plant, if it wasn't illegal.

                        longk, it's quite common in bird seed. Asda also sell the seeds as a 'nut' type thing in with the 'healthy stuff to put in your cereal bowl and baking' section.
