House problem

    Retired but still grubbing the soil.

    Problem.
    House being sold by children of deceased parents but no sign of house deeds. Land Registry have no records.
    Property was purchased for cash over twenty years ago.
    Of course proof of ownership is required before Sale.

    Any ideas folks?

    About 1990 they changed the bulky package of all the original deeds to a much simpler few bits of paper issued by the Land Registry, which meant you didn't need to pass on all the history of the house to the next buyer.

    Tricky if they have no records though. If deeds are not in the house contents then they could be with a Solicitor. Probably not with the bank if it was bought for cash.

    Trouble is, about that time you could start shopping around for the cheapest conveyancer, so the deeds could be anywhere in the Country.

    Might pay to get in touch with The Law Society, see if they have any suggestions.

      I do hope that everything can be sorted out for them.Evidently a lot of deeds are held electronically so when we have paid our mortgage off,I think I am going to ask for a copy of the deeds just so we can farme them to show the house actually is ours:D

        No help at all, sorry, but surely the whole point of the Legal Eagles is to sort out the formalities ? Can't you kick the Conveyancing Solicitor?

        I thought it was a legal requirement to register ownership with the land registry. I have no idea where the deeds to my house currently are, and until I read this thread I didn't care, because I figured it was just a bit of paper, and the important bit was the record at the land registry.

          Do they know who were the original solicitors from 20 years ago? There's an outside chance they might have copies of some of the transactions.

          Registration with the land registry occurs when properties are being sold, there was no 'catch up'. Once your property is registered then the old paper title deeds are of no importance legally.

          That happens the first time it changes hands, or some other relevant transaction occurs on the property, I think.

          If you have a mortgage probably with the lender, else if it has had a "relevant transaction" recently [dunno the cutoff date though] (including the mortgage ending) then with the land registry. Hopefully!
