selling cars at home

    this guy has moved opposite me and hes selling a load of cars outside his house on a main street, its most annoying cos hes not happy with having them all on his side he decides to park a car outside mine so i cant get parked at times.
    is this illegal to do this ive called council parking control 2nd time now and they havnt got back to me, my friend said its illegal to do this

    Basically it sounds to me like unlawful street trading rather than parking. Ring the licencing dept of your council, not the parking. I think he shouldn't be allowed to carry on that sort of business in a residential area. He's probably avoiding paying any business rates as well, so check he is actually licencesd to do this first. If not the council should stop him. I wish you luck.

    From what I remember of parish council meetings, he should have applied for a form of planning permission to run this business from home, giving you the opportunity to raise opposition.

    Our parish council denied permission for someone who wanted to open a beauty salon in her garage! If he's just moved in, it sounds like he is operating under the radar.

    Couldn't you get some help in complaining from other residents? The council will eventually respond though.

    well he keeps moving cars, taking some away then bringing them back some got no for sale signs on them others do then after a few days he put for sale signs on the other cars, when i ring the council there is different depts to go to, i might try another one, i got the number from the main council office.

    Have you a parish council? They deal with stuff before it moves on to the big boys (town and county council).

    Ring your local council's "licencing" dept Rosa, they are responsible for controlling activities like this :gnthb:

    If he is selling them privately, I doubt there is anything legally that can be done, as long as all the cars are in his name and taxed.

    If he is buying the cars to sell on, and doing the trader's trick of not changing the ownership details when he takes possession of them (so that he doesn't get listed as the previous owner after the sale) then it could be argued he is running a business, and would therefore need the necessary permission to trade in the street.

    Personally, if you really want this guy to stop, I'd be thinking about telling the tax man. They'd be very interested in hearing about someone who is actively trading for profit and not declaring it, but it is a pretty nasty trick and I'd save it for the last resort.

    There are quite strict rules to protect us from dodgy traders pretending to be private sellers. A car trader is a person who regularly buys and sells cars for purposes other than their own personal use, and this person fits the bill. Therefore he must be licenced by your local council. It doesn't matter if he claims he is a private seller himself. Ring the licencing dept Rosa, they will act on this sort of thing. :thumb:

    Take pictures Rosa, compile some evidence and present it to the right department that deals with unlawful street trading. Plenty of foliage to sneak behind to get the photos:lollol::gnthb:

    Inland revenue might be interested aswell, collect evidence.

    If they are parked on the road it is a legal requirement that they are insured-whether they are driving or not.

    Hi rosa, as has been said it looks like he is illegally trading. However you (or 'one' to be precise) don't have a 'right' to park outside your residence unless it is permit parking or if you have a dropped kerb or a garage.

    If I remember rightly you live in a flat- don't you have allocated parking? If not then perhaps the only way is to go through the 'illegal business' route as has been suggested. Hope it improves for you.

    My Friend had a problem with this, and they kept a record of the cars that were for sale on a certain date, and when they were moved on. I know that it may be a bit of a hassle for you, but it will be worth it in the long run. They got it all sorted out, and the people moved.

    As well as trying the local council, and HM Revenue and Customs, have you thought about Trading Standards?

    Before the witch hunt begins, it might be worth considering that he might be just tried to feed his family. Maybe the best place to start is to have a word with the bloke himself. He might be spreading his cars about the street because his next door neighbours have already complained. I'd only get nasty (call the tax man) as an absolute last resort, if you give him a chance to be reasonable and he responds with nastiness.
