    Hi,

Has anyone else had a problem with Mirrorgarden.co.uk?
I ordered £60 worth of plants from these guys about 4 weeks ago on the advice of my father in law who has used them for a couple of years.
I received notice that half of the order would be shipped within 28 days and the other half (plug plants for hanging baskets) would be sent in May.
    This seemed fine.
I received the first part of the order on Tuesday 25th March, just after the bank holiday weekend.
When I further inspected the package, I noticed that it was shipped on 18th March.
Upon opening the box (which was labelled - live plants-URGENT), I noticed that the plants were in terrible condition. One was snapped, the tubers on the dahlia bulbs were broken away from the crown and the rest of the orders leaves were shrivelled and dying.
I emailed the company immediately and outlined the problems expecting an email back with some kind of apology and solution.
I received nothing over email and got a letter through on Saturday's post. The letter didn't accept any blame for this (although I think it would take an idiot to send out live plants on the longest bank holiday weekend so they sit in a courier depot for days). They just advised to nurse the plants and once the weather picks up to plant them, "once planted and established they should revive very quickly". They state that if they should fail to survive let them know.
I do not see why I should have to nurse very sick plants because of their mistake, and if they do die after being planted, then I have the hassle of finding similar plants at the same stage of growth as the rest of the garden.
I will obvioulsy be phoning this company tomorrow and cancelling the rest of the order (the hanging basket order). I will then be placing an order with Van Meuwen. Has anyone had any experience with this company?

    Rant over ;)
Has anyone any comments on my situation?

Oh Bashy, i can't offer any input, but i know there are lots of people on here that use the net for ordering plants, & i'm sure someone will come back to you with advice.

I hate incompetentacy(spelling!)in companies of any sort.

    A mistake is acceptable, incomp.......not!

You will get the advice on here you need to go back to your supplier i'm sure.

    cheers

my first mail order of plants was from Mirrorgardens. I found the delivery OK, But the quality of plants was poor in my opinion.
If the post was delayed getting to you - tell them it is their responsibility not yours - you are not prepared to nurse their mistake, and you want immediate refund/ exchange.
Don't email or write to them call them and politely explain the situation , go for a refund or immediate replacement.

    hope this helps

    Hi all,
Just phoned these people and explained again what I had already said in my email.
Was greeted with a useless response of "they will be ok when planted".
They did not offer any apology let alone a refund. They even claimed it's usual for plants to be in transit for a week!!!!!
When I asked for a refund they refused.
I have now cancelled the rest of the order and will be placing a formal complaint with the company (not that it will do any good).
I would advise anyone who is thinking of putting an order in to this firm, DON'T...They are highly unprofessional and their customer service is non existent.

    Cheers

Being in dispute with an eBay seller at the moment, I've been reading up on the Distance Selling Regulations and Sale of Goods Act. I'm reasonably confident that:

    * According to the DSR, they are responsible for the items until they have been delivered to you.

    * The items sold to you are not "fit for purpose", and as such you should be legally entitled to a refund. You will have to return the items (I'm not sure if you can demand the return postage from them though).

And unless there's an exclusion for live plants (I never looked that up because it happened to be garden equipment I ordered), they have a legal obligation to refund the goods if they have failed to deliver them to you safely.

I put in an order from T&M for two Athyrium young plants. They were posted from Guernsey on 18 March and were waiting for me when I came back to work on 25 March. They were still moist and in good condition, despite minimal packing (a little snap-together tray, with cardboard wrapped round it and taped in!). There should be no exuse for drying out, and there IS no excuse for broken plants.

Did you pay by credit card? If so, you're covered by your credit agreement and can dispute the payment. Your credit card company will take over the dispute for you.

Mr Juliasaurus is a non-practising lawyer, and any advice he gave would not be in his capacity as a lawyer but as a "friend of a friend", but I can send this thread to him and ask him if he can add anything to what I've said.

Thanks very much Juliasaurus, but I think I'm just gonna put this one down to experience.
I'll definitly be giving them some serious abuse in the letter.
    Thanks again.

Bashy, go to your local trading standards office, this is what they are there for. This nursery has taken YOUR money and you are entitled to it back.

Thanks for the warning Bashy - I'll tell all my gardening contacts to steer clear of them!
