Trees and Neighbours.

    Hi All,

    Can anyone offer any advice on the following.

    The bloke who lives in the house at the bottom of the garden is complaining about the trees at the bottom of my garden. He hasn't spoken to me yet as we were out but my neighbour has given me the heads up. My old neighbour who lived in the house for over 50 years once told me the trees were put in by the council many years ago to help with the excess water. But this didn't work and the put a culvert in to divert the stream that was there. The neighbour who moved in when she left told me that the trees have preservation orders on them. How do I find out? And am I right in thinking that if do the trees cannot be touched. I don't want this to become an issue between us, but I like the trees ( as does the wildlife) and also offers privacy as they would overlook us.

    To be honest first thing I'd do is find out from the horses mouth whether your neighbor actually has a problem with the tree's or not :redface:

    secondly you can find out if the tree's have Tree Preservation Orders (TPO's) on them by contacting your local council who will be able to advise you http://www.solihull.gov.uk/parks/tpo.htm

    Thanks Aesculus I will check it out tomorrow. I will wait for him to come and see me I just thought I would try and find out first as what the neighbours have said he told them he will be back to speak to me.

    If the trees don't block light or shade his garden too much I wouldn't worry.

    Some people get muddled about protected trees in Conservation Areas and those with TPOs on them, so this is something else to check out with the Local Planning Authority using that link above.

      If you like the trees,
      IF he comes to you, state that you do not like them either but there is a TPO on them, and leave him to do the footwork :-)

      They will either accept it, or spend hours and hours of their time with the council then come to you and say it was incorrect they do not have TPO, "THEN" You negotiate
