It never rains but it pours - Advice please

    Sorry for the thread but had to vent, plus ask for advice.

    We have had a rotten month. Two bouts of cold/flu a death in the family and now this damage caused by a contractor to our stink pipe.

    Our fencing contractor I'm pretty sure did this and it seems only right that they pay for the repair. However OH's Nan died a few weeks back and isn't in the mood for any more confrontations or setbacks with the house. He's busy helping his family clear out the house before its given back to the council.

    Do I have any legal right to make the contractor fix it or do I need to supply proof, take him to court etc?

    Was hoping this week off to have some time together to keep his mind off the death of his Nan but will have to fix this problem instead.

    It never rains but it pours. :(

    Sorry to hear all your troubles Jane. I can't quite work out what your photo is showing, is it a hole in the stink pipe below ground level? Is it a hole into cast iron? Maybe the contractor was using a breaker and went through the pipe? It's very hard to tell, generally cast iron shatters, it's very difficult to drill, so maybe it's rusted through?

    From the pic it doesn't look like a clean breakage of sound material, more rather like an already defective area that may have been disturbed whilst working.

    P.S. Is that pipe cast iron (or asbestos cement)?

    Don't know Jane but that pic looks like something out of a horror film.

    Call or preferably write to them stating what you believe to have happened with supporting photos. They might just come round and fix it but as you mention, there's bigger things to concern yourself with right now.
    If the house is being handed back to the council then let them deal with it.
