Japanese Maple - too far gone?

Hello folks, am hoping its not the case I know (or ive heard) these can be rather fragile. I have scratched a small part of the branches and I can still see green underneath but was wondering if it is normal this time of year or if it should be looking more healthy! Hoping it is not too far gone after the winter, and tips/ advice would be greatly appreciated. Thank you!

 

It looks alive to me, as far as I can see in the picture.

 

RHS here say it likes to be cool, out of wind in a bit shade?

Doh on me... It's a Acer. To be blunt I only really like growing food and always hated gardening, but the older I get the more I seem to enjoy it, even the flower/tree side. We actually have 2 of these in the ground with one just out side the window. As per @waterbut it looks almost the same, but I can see lots of healthy looking buds quite clearly.

 

Thank you so much folks, will bear with it and hopefully it will start to look a bit more healthy. I was concerned m,ainly because one of my neighbours has one (which may be an acer not sure) which is wrapped in the anti frost sheeting and looks a million times better but hopefully this will recover.
