Ordered a New TV from ASDA Direct...

    I bought a new TV with all the bells and whistles on Monday from ASDA Direct at a really good price and planned for it to be delivered on Wednesday (yesterday) turns out they where actually out of stock and I won't have it for at least a week:mad:

    and you know what the most anoyying thing about this is? they actually have over 10 in stock about 4 miles away:gaagh:

    I asked about just getting it in store and they said I would have to cancel the order and then wait 4 days for the money to be returned as I don't have enough just lying around... and then pay £50 more as as the price had gone up since my initial order:mute::nono:

    a couple of words spring to mind, none of which are repeatable here:thud:

          Hi Aesculus. I had a problem some months ago with ASDA PRICE!!!.
          I was looking for a T/V on Asda on line for my sister in law . I selected one,cost £210. I took a print out to show her the set,she was delighted. I told her I would go down to the store and purchase it ,collect it and tune it in ,all done in the one day.:thumbsup:.

          I went into the store, seen the same set on display, Cost £250 :scratch:.
          I approached the sales person, questioning the price,her reply was " Oh Yes We Do It Cheaper On Line" :scratch:.

          Needless to say, I purchased it on line, delivered in 2 days,:thumbsup:.

            I'd just shrug my shoulders, and wait for the original order to arrive.

              That's what I'm doing now but I could be waiting any length of time according to CS and there's no definite date when there going to be back in stock... I could be waiting weeks! for them to turn round and say "sorry we couldn't get it" and cancel the order:mad:

              I hate shopping when things like this happen:wallbang: I've sent them an email and letter so hopefully I will here something positive soon

                  No sympathy here - that'll teach you to buy on-line from the chains!

                  Print the web page off and go to your local indy - all the good ones will match it. Got a new fridge freezer last month, same price and delivered in a 2hr window on our day of chosing.

                  Continue to buy on-line or from the chains and all high streets will be a clone of uk plc........

                  If they've taken your money, they've entered into a contract of sale. They have to supply the goods in a timely fashion. Within the timescale they implied at the moment immediately before you confirmed the order.

                    Nope, defo as soon as they accept your money. Its the Sale of Goods act vs the Distance Selling act.

                    In a disagreement, the seller will try to direct you to the Distance Selling act, in the hope that you accept that they're right and give up. In fact the Distance Selling act is kind of built on top of the Sale of Goods act, in the sense that the Sale of Goods act takes precedence wherever there's ambiguity between the two.

                    So, under the Sale of Goods act, the contract of sale began when they accepted your money. However, under the Distance Selling act, you have so many days to cancel your order and claim a full refund, minus any costs they've already reasonably incurred.
