based on your above post, the problem that I see is perhaps you are a bit of a 'stirrer', and they have decided that they are better off without you ....

perhaps they discussed the situation behind closed doors before they decided to jack up the rates, and knew you would object, and this would be an 'easy' way to get rid of you

as far as the new rates, if you google, they fall in line with many councils ....

they know there will be objections, and many will leave, however, there is a long waiting list for allotments

I'm not slagging you, but am merely saying it as I see it, .... and that is from reading your last post as regards the flag, rat poison etc etc

I think that what dim means is that the Council see you as a "bit of a stirrer", Simon, and that because they know you would object to their plans there is a plan of action against you, it's not ethical but is legal within their rules and perhaps in a Tribunal it would be seen as constructive dismissal regarding tenancy.

I think Steve's suggestion about a meeting with the Council in some shape or form is an extremely good and logical one even though there are "fence" that are broken and perhaps can't be mended. If that happens I would recommend that you take someone as a "friend".

Thanks *dim*, yes I'm sure that's how the Council see it.

Thanks Armandii, yes discussion and negotiation is the only way to resolve the conflict, but the Council completely refuse to have any discussion.

      Simon,
I ,along with the other GC members, wish you luck and I too, offer my support to your cause. As if their isn't enough to keep them occupied in more deserving matters. [IMG] One wonders sometimes,
      All the best,

Thanks Jenny namaste. It's been a lot of hassle but the nice thing is I've not forgotten what it's actually all about:

Is there a long waiting list? If worse comes to worse, re apply under a different name.

Thanks ziggy searchfield, but that won't work, they know my address and they know what I look like.

I think the Flag and the wee hut along with the diatribe states all

You have an agenda, in doing so you have cost your fellow man who has no allotment a lot of money subsidising YOU and paying the councils fight

Was your tent safe outside St Pauls or were you on gardening leave ?

This snipped from Simon's own Facebook tome seems to clarify the position fairly well. It would seem clear that The Council and the fellow allotmenteers are as one against this stance. The public statement issued by the Council in Feb. 2011(see above) seems valid.
Simon Kirby I think the simplest thing to say is that none of the town councillors will talk to me. I'm not sure that many allotmenteers know what's going on as I don't discuss it with them. The committee of the allotment society decided some time ago not to support me but to "work with the council".

              Go for it Dopey.
There's plenty of info in the public domain already - including the open letter yesterday
, signed by JSH, confirming the implimentation of the eviction notice and fencing off the specified allotment and stating the various reasons.

Probably the same generic reply we all got from JSH.

Your probably right but here it is anyway
              Dear Mr ******

              Thank you for your email.

In a dispute, there are always two sides to the story, as I’m sure you will agree. It will help your understanding of the overall situation, therefore, if you are aware of the Town Council’s position as well as that of Mr Kirby.

I include below a link to Newbury Town Council’s public statement on the issue today:
              www.newbury.gov.uk/pdfs/news/allotmentservice120404PR.pdf

It sets out the Town Council’s position in detail and also refers to other publicly-available information (via hyperlinks in the document) which will further help your understanding of the overall situation.

              I hope this is helpful.

              With best wishes

              Julian Swift-Hook

Yup...same generic reply from him, I have replied and asked that one councilor spends one hour maximum to speak with Simon in a last ditch attempt of a resolution. But I also stated that both perties would have to have an open mind, and both would have to use give and take.

              Steve...:)
