I can't believe the police were going to charge £150 to come out and look at her car, its daylight robbery. Given that you already have done their job by finding it and recovering it, I would have thought they would would have been keen to come out and collect their money which is all they are interested in these days.

I'm glad you have it back now Sam and hope you can easily get the damage sorted.

If someone steals a car and injures a third party they claim off the car owners insurance and a friend had the bloke that stole his car trying to claim off his insurance cause he was seriously injured!!! Last I heard it was still being fought

That's outrageous. The legal battle should be an easy one as far as I can see. If someone steals a car, then by definition they have taken it without the owner's permission. If the owner hasn't given permission for the driver (the thief) to take the car, then the driver (the thief) is not insured.

It's like if I borrow my dad's car, with his permission, I'm insured. That's because my policy says I can drive someone else's car with their permission provided they have normal 3rd party cover. The policy wording is quite clear that I have to have the owners permission, so if I took my dad's car without his permission, then I'd be an uninsured driver. Surely the same applies in the case of a thief stealing a car.

The whole thing makes a mockery of decent law abiding people, who lose out at every turn while thieves and unscrupulous insurers (the same thing) make loads of money at the expense of others without any fear consequences.

Just seen this Sam. I'm delighted you've got it back relatively intact. As for the police attitude...speechless!

Why not pop round to the local police station and ask for a complaint form? You have a right to make a complaint about their attitude and lack of care/service/inability to do their job. You might find yourself being taken a lot more seriously by them after you do that. But still make the complaint. I know it works - a friend up in Doncaster was having issues with break ins at her allotment and the police response was lacking to say the least. She filled in the complaint form and suddenly they were bending over backwards to be of assistance!

That's exactly how I feel about it. I must remember to ask him about it, might send him a message on Facebook and find out the outcome. I know they took his no claims away and said he could have them back if he won.

Wow, just caught up with this - I know what I want to say but like is on here, I'll hold back. Don't let it go. I know the police (authorities etc) have alot to cope with what with paper etc, but pester them a bit. Let's make 'them' care more.

    cheers

I haven't heard from my mate yet but I've heard from another mate who might be going to prison in jan cos he was in a fatal accident in dec and 2 people died, his mates and the other driver paralized. He wasn't even driving he was sat by him on L plates and he's been charged for aiding betting gbh and death caused by dangerous driving even though he was passenger!! I wasn't aware that you could be charged if you were the person sitting next to the learner.

Glad u got the car back Sam it might be worh putting a cheap alarm on the car or at least one of those steering lock things to put anyone off stealing it again and causing you all this hassle

You're the one who's 'responsible'. The learner, by definition, can't be fully responsible because they've not yet proved they can drive properly. I can remember the feeling of apprehension I had when driving my then girlfriend home one evening in falling snow. I was still the learner and the original intention was for her to drive home, but looking into the falling snow was making her ill. She was obviously not in a fit state to drive. I was terrified we'd get stopped by the police!

Glad you found your car. The police & insurance companies are useless aren't they? My mums car got stolen from a garage where it was in for a service on the 19th march. cctv pointed right at the car but mysteriously no coies available for the time of theft (no worries for before and after though). Was obviously an inside job, police said has happened at same garage before but not enough evidence to do anything. Car was 3 months old, brand new. Insurance have refused to provide alternative car or pay out on it, or pay it on (was on a pay by month scheme). Car was found last week in Lithuania. Insurance company shipping it back and said to mum would return car and if OK, no compensation. ???? extra miles, now 10 months old etc etc. they have been awful, mum phones them every week and they never keep her informed of what's going on. In the meantime, she has a 60 mile trip to work with no car!!! Dreadful. So, others going through similar issues!

A precedent was set a while ago when a drunk driver in a jag ploughed into a broken down car at 120+mph. His female passenger was done because the court said she made no attempt to discourage him from driving while drunk, or driving too fast. A certainly goes against what I was taught when I was a learner, that the driver is solely responsible for whatever happens to the car.

MZ, that's terrible, your poor mum.I hope she's put the word about and the garage gets no more work. It must be obvious to those that work there who's responsible unless it's the owner who's doing it.

clueless1 - I thought the same. How can the passenger really be responsible for what the driver does? I understand about drink driving but bllimey!

Sam - I too hope that you get your car back but I feel it's never the same. I've had a car nicked a couple of times - not bad in 30 years of owning them - and each one, although not new, felt like it was mine if you know what I mean & I hated the fact that someone else had used them.
    cheers
