I agree with clueless. They've been pulling your .... :heehee: and trying to get out of their responsibilities.

Give them the rst of their 28 days as you only have 7 to go. Then make sure that they give you a refund. According to your post above, they said 'refund or replace' so hold them to the 'refund' part. It seems as though there may be an inherent fault in the model so I wouldn't be happy with them replacing it for the same thing.

I remember when I had a similar issue (bluescreen) The technician told me to do a restore by tapping the F11 key repeatidly whilst I was turning on the computer.
Maybe you could try that, since you say the laptop is new, therefore you would have no data to worry about in there...

If he can take a photo of it then I would be inclined to phone them and say that you are not going to wait until the end of the 28 days and want a refund immediately. If they start to argue just say you have taken advice and that under the Supply of Goods and Services Act you are entitled to the refund. If they ask who gave you that advice just say, a consumer adviser. If they still argue then say you have been advised to go to the Small Claims Court.

I had a similar issue with a TV that we bought from Comet years ago - in and out of the shop with the thing (and given that it was a 28" CRT widescreen, you will appreciate that it weighed a fair bit), and even supplied photos of the fault - still they refused to replace it and insisted on trying to repair it.

They even went as far as sending an engineer out to the house, who claimed to have re-soldered a dry joint on the LOPTX, which was something of a miracle given that Mrs C told me that he didn't even turn the set round let alone take the back off it (I was at work when he came)

Suffice to say, it failed again that evening, so the following morning I bundled it into the back of the car and took it to the Comet store where they refused to replace or refund it. So, I carted it back out of the shop and put it in the open boot of my car which was parked at the shop door (literally couldn't have got any closer if I tried) - and then I needed a rest, so sat there for half an hour on the lip of my boot, telling everyone who was coming into the store the problems I had with the TV and the treatment we had received.

The store manager gave up about half an hour or so in (I'd have sat there all day), and asked me to bring the TV back into the shop so he could arrange a replacement - I ended up leaving with a higher spec TV on sale for £200 more than the one we took back for no extra charge, and had a 5 year warranty chucked in.

That's very common rusty as the store will have a weekly quota for customer insurance they wouldn't care that you will cancel the insurance the next day as you've still helped them with there target ;)

I did a short stint at a catalogue retailer who have similar customer insurance policies and they work on a similar target based system (just without the discount xD)

Now ziggy you need to go in and demand a refund! If the manager refuses ask for his full name name and the shops company reference number then phone customer services and complain about him personally also write a letter as well explaining in great detail why you have been put off purchasing ever again from them and that you will be telling all your friends about you bad experience really lay it on thick and don't pull any punches tell them how they are basically screwing you over! also mention that you are perfectly within you rights to demand a refund especially because it is within you legal statutory rights of 28 days
